You set the timetable and are in control of the pace. Some couples need only two or three meetings to reach agreement; others need more. The process will take only as long as you need it to.
Costs vary from case to case depending on the complexity of your case, the number of meetings that are required and the length of those meetings. The typical cost of a collaborative case is between £2,000 and £5,000 each, inclusive of VAT and any payments to third parties.

Many couples are choosing the Collaborative Law approach because they feel it offers them the best opportunity to reach a fair solution whilst minimising the pain of family breakdown. Within the process you still have the benefit of having your own independent legal advisor but you are in control, without the threat of Court proceedings hanging over you. The process enables you to maintain contact with each other and work together to reach a better understanding of each other and amicably work out how to share assets and responsibilities if you go your separate ways. If there are children involved, adopting the Collaborative Law approach to matters shows the children that you are working things out together and can help them cope better with your separation.
For Collaborative Law to work, you and your spouse/partner will need to share a genuine desire to make it work, be willing to fully and honestly disclose information to each other about your financial and personal circumstances, and agree that you will reach a solution without going to Court. It is unlikely that Collaborative Law would be appropriate in cases where there has been history of domestic abuse (Domestic Abuse Factsheet). If you are not sure whether the process is right for you please contact Lorna Sear or Paul Cobb for further information.
